Terms of Use
These Terms of Use ("Terms") govern your use of the KinetiqLoop iOS application and the website at kinetiqloop.app (together, the "Service"). The Service is operated by KinetiqLoop, an Ontario sole proprietorship ("KinetiqLoop", "we", "us", or "our").
By creating an account, using the app, starting a workout, or purchasing a subscription, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use KinetiqLoop. If the laws where you live require a higher age to use online services or consent to data processing, you must meet that higher age requirement.
2. Fitness and health disclaimer
KinetiqLoop is not medical advice. The Service provides general fitness, workout, recovery, and wellness information for educational purposes only. It is not a substitute for professional medical advice, diagnosis, treatment, physical therapy, or emergency care.
Exercise involves risk, including the risk of soreness, injury, illness, or aggravation of an existing condition. You are responsible for deciding whether an exercise, workout, recovery recommendation, or training program is appropriate for you.
- Consult a qualified healthcare professional before starting or changing an exercise program, especially if you have a medical condition, injury, pregnancy, or other health concern.
- Stop exercising and seek medical attention if you feel chest pain, dizziness, faintness, severe shortness of breath, sharp pain, or unusual symptoms.
- Use proper space, equipment, warm-up, and judgment. Scale or skip movements that do not feel safe.
- Apple Health data and recovery insights are informational only. They do not diagnose medical conditions or replace professional care.
3. Your account
- You are responsible for keeping your login credentials secure.
- You agree to provide accurate account and profile information.
- You may not access another user's account or interfere with the Service.
- You can delete your account in the app under Profile > Privacy & Data > Delete Account.
4. Free and Premium features
KinetiqLoop may offer free features and Premium features. Premium may include expanded workout access, Visual Anatomy Intelligence, Apple Health recovery insights, Body Mapping Score, custom workouts, the Exercise Library, Biomechanics Lab, recovery timelines, imbalance insights, recovery-ready alerts, recommendations, structured programs, and other paid features shown in the app or paywall.
We may add, remove, rename, or change features over time. We will not remove paid access during a billing period in a way that materially defeats the subscription you purchased without providing a reasonable remedy where required by law.
5. Subscriptions, billing, and cancellation
KinetiqLoop Premium subscriptions are sold through Apple In-App Purchase / StoreKit. Apple processes payments, renewals, cancellations, and refunds for App Store purchases. We do not receive or store your credit card number.

Introductory offers apply to eligible new subscribers through Apple In-App Purchase. After the intro period, your subscription renews at the regular price unless you cancel at least 24 hours before renewal. Prices may vary by country, taxes, App Store region, currency, and promotions. The price shown by Apple before you confirm purchase is the final price for that transaction.
- Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
- Your Apple ID is charged according to Apple's App Store terms.
- You can manage or cancel subscriptions in iOS Settings > [your name] > Subscriptions, or through Apple's subscription management screens.
- Cancellation takes effect at the end of the current billing period. Deleting your KinetiqLoop account does not automatically cancel your Apple subscription.
- Refund requests for App Store purchases must be submitted to Apple at reportaproblem.apple.com.
6. Notifications
Optional local notifications (workout reminders, weekly progress, program session reminders, and recovery-ready alerts) are scheduled on your device. We do not operate a push-notification server for these alerts in V1. You can disable categories in the app or iOS Settings.
7. Analytics and promotional email
We collect limited usage analytics through Google Firebase Analytics to improve the Service, as described in our Privacy Policy. You can opt out in Profile > Privacy & Data.
When you register or sign in, your email is added to our promotional mailing list for KinetiqLoop product updates and offers. There is no separate marketing unsubscribe in the app; delete your account if you want to stop promotional email. Transactional email such as password reset remains available while your account exists.
8. Acceptable use
You agree not to:
- Use the Service for unlawful, harmful, abusive, or fraudulent activity.
- Attempt to bypass Premium access controls or payment systems.
- Reverse engineer, scrape, copy, resell, or commercially exploit the Service except where law permits.
- Upload or transmit malicious code or interfere with the backend, APIs, or other users.
- Use the Service to provide professional medical, nutrition, or training advice to others without appropriate qualifications.
9. Intellectual property
The Service, including software, design, workout content, exercise descriptions, visual anatomy interfaces, text, graphics, logos, and trademarks, is owned by KinetiqLoop or its licensors. You receive a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal fitness and wellness purposes.
10. User content and feedback
You keep ownership of information you provide, such as workout notes or support messages. You allow us to use that information as needed to operate, support, secure, and improve the Service. If you send feedback, ideas, or suggestions, we may use them without obligation to compensate you.
11. Third-party services
The Service depends on third-party services, including Apple for App Store subscriptions, Railway for backend infrastructure, and Cloudflare for domain, DNS, email routing, and static website hosting. Those services may have their own terms and privacy policies.
12. Availability and changes
We aim to keep KinetiqLoop reliable, but we do not guarantee that the Service will always be available, uninterrupted, secure, or error-free. We may modify, suspend, or discontinue parts of the Service for maintenance, security, product, legal, or business reasons.
13. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, create risk for other users, abuse the Service, or if we are required to do so by law. Sections that by their nature should survive termination will continue to apply.
14. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability.
15. Limitation of liability
To the maximum extent permitted by law, KinetiqLoop will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, personal injury, or business interruption arising from or related to the Service. Where liability cannot be excluded, our total liability for claims related to the Service will be limited to the amount you paid for the Service in the 12 months before the claim.
16. Indemnity
You agree to defend, indemnify, and hold KinetiqLoop harmless from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of the Service, violation of these Terms, or violation of another person's rights.
17. Governing law
These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Courts located in Ontario will have jurisdiction over disputes, except where consumer protection laws where you live require another forum.
18. Apple-specific terms
If you downloaded KinetiqLoop from the Apple App Store:
- Apple is not a party to these Terms and has no obligation to provide maintenance or support for the app.
- Apple is not responsible for claims relating to the app or your possession or use of it.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
- You represent that you are not located in a country or region subject to applicable embargo restrictions and are not listed on applicable prohibited-party lists.
19. Changes to these Terms
We may update these Terms from time to time. If changes are material, we will provide reasonable notice in the app, by email, or by another reasonable method. Continuing to use the Service after updated Terms take effect means you accept them.
